The main penalties applicable to the natural persons regulated by the new Criminal code

Summary/Abstract: The article represents an analysis of the system of the main penalties applicable to the natural person and regulated by the new Criminal code. Oscillating between tradition and innovation, the authors of the new Criminal Code (already modified several times even before its entry into force) regulate a system of main penalties for the natural persons, whose validity will prove, or not, in time. We highlight the issues of novelty as well as those of continuity kept from the former regulation.At the end we make assessments on a possible improvement of the current provisions. Broadly, the system of penalties for the natural persons as it is regulated, meets the social exigencies in relation to the criminal phenomenon and, at the same time, it brings its contribution to the social reinsertion of the major criminals. Without doubt it is perfectible, and this fact will be noticed once the time passes. A lack that can be ascertained even now is that it was not considered appropriate to include among the main penalties the community service. It is true that we can reach such penalty, but only by indirect means, as it was seen.
