The new regulation of the accessory penalty

Summary/Abstract: The article analyzes the regulation of the accessory penalty in the new Criminal Code, adopted in 2009. Both the general framework of regulation and the regulation itself are presented. The latter departs from the definition of the accessory penalty, and continues with analysis of the content and manner of execution. Finally it is shown that under the new regulation, the accessory penalty is too dependent on the complementary penalty of the prohibition of certain rights even though both have the status of secondary penalties.
