Summary/Abstract: The institution of judicial guardianship (probation supervision) for adults should be given legislative solutions at the systemic level. This assumes taking into account the necessary juridical criteria assuming the achievement, in the executive practice of guardianship, of tasks and aims related to permanence, accuracy, effectiveness, efficiency, cost-intensity, functionality and innovativeness. To this end, the probation officer should become a subject possessing the knowledge, competence and skills to formulate an anamnesis, diagnosis, catamnesis and prognosis with respect to each person under their care. Moreover, at the level of dynamic-evolutionary changes, the probation officer should gain the rank of a judicial body co-deciding on the choice of punitive response within the probation system. The qualifications of probation officers to formulate an individual, environmental and civilisational-cultural diagnosis may lead to conceiving of judicial guardianship as a polyfunctional model attesting to the implementation of probationary measures of a custodial, educational and therapeutic profile. Adopting such an analytical scheme for the guardianship system assumes the need for their work to be based on the casework strategy - the individual case procedure.
