Summary/Abstract: The probation system is a novelty within the framework of the model of legal-criminal liability developed at the turn of the century. It assumes abandoning the dominant role of the penalty of deprivation of liberty in favour of medium-intensity penalties, non-custodial penalties, and social sanctions. Contemporary trends in criminal and penitentiary policy proposing solutions related to the probation system represent a new quality and are not aimed at merely reordering the old legal order. According to praxeological knowledge, "diluting" the isolation system with probationary responses leads to reforming the system at the level of stagnation, i.e. it does not improve its effectiveness. The innovative model of criminal liability based on probationary measures draws attention to the aims and tasks of penalties in the area of prevention rather than repression. Preventive interventionism assumes the inclusion, integration and favouring of convicts within society, rather than their exclusion or communal banishment.
