Conditions for whistleblower protection and its limits

Summary/Abstract: Only persons who meet numerous conditions set out in legal regulations are entitled to protection for reporting breaches of law. These conditions differ in relation to protection against retaliatory measures at work and in relation to possible reprisals in the form of criminal or disciplinary proceedings against the whistleblower. Not everyone is guaranteed protection despite reporting or disclosing in public a breach of law according to appropriate procedures. The article discusses the complex requirements for whistleblower protection and its limits. It also proposes changes to the Polish Act on whistleblower protection aimed to improve the existing system.
