Summary/Abstract: I. The Applicant and the Subject of the Referral The referral made by the Galați Tribunal in Case No. 1296/233/2014, through the hearing order of 16 May 2014, requested the issuance of a preliminary ruling for the principled clarification of the following question of law: whether, in the application of art. 21 paragraphs (1) and (3) of Law No. 187/2012 for the implementation of Law No. 286/2009 on the Criminal Code, an executable prison sentence exceeding 5 years imposed for offences committed during minority is to be replaced with a) the educational measure of placement in a detention centre for a duration equal to the prison sentence, or b) the educational measure of placement in a detention centre for a duration of 5 years.
