Summary/Abstract: The High Court, deliberating on the appeal in the interest of the law, notes the following: The legal issue that generated non‑unitary case law Through the appeal in the interest of the law filed by the Governing Board of the Brașov Court of Appeal, it was shown that national judicial practice does not present a unified point of view regarding whether, in the interpretation and application of Article 7 of Law No. 76/2008 on the organization and functioning of the National System of Judicial Genetic Data, the collection of biological samples should be ordered from persons definitively convicted to imprisonment for the offences listed in the annex to Law No. 76/2008, even in cases where the execution of the sentence is conditionally suspended or suspended under supervision.
