Summary/Abstract: The High Court, deliberating on the appeal in the interest of the law, notes the following: The legal issue that generated non‑unitary case law In the appeal in the interest of the law filed by the Prosecutor General of the Prosecutor’s Office attached to the High Court of Cassation and Justice, it was shown that national judicial practice does not present a unified point of view regarding “the legal classification of the act committed by a natural person who holds, outside a fiscal warehouse (although not being an authorized warehouse keeper), excisable products exceeding the legal limits, unmarked and originating from smuggling.”
