Summary/Abstract: The High Court, deliberating on the question of law with which it was seized, notes the following: 1. The Applicant and the Subject of the Referral The Botoșani Tribunal – Civil Division I, by the hearing order of 2 April 2014 delivered in Case No. 13696/193/2013, referred the matter to the High Court of Cassation and Justice, pursuant to the provisions of art. 519 of the Civil Procedure Code, for the issuance of a preliminary ruling concerning the question of law relating to the interpretation and application of the provisions of art. 527 paragraph (2) and art. 529 paragraph (2) of the Civil Code, in correlation with the provisions of Government Ordinance No. 26/1994, republished, as subsequently amended and supplemented.
