Summary/Abstract: I. The Applicant and the Subject of the Referral By the order of 27 March 2014, delivered in case file no. 5559/111/2013—concerning the appeals lodged by the defendants F.C.F., B.M.O., I.S.D., D.I.S.V., R.G., and L.Ș.T. against criminal judgment no. 147/P of 28 February 2014 of the Bihor Tribunal—the Oradea Court of Appeal, Criminal Division and Division for Cases Involving Minors, referred to the High Court of Cassation and Justice, pursuant to Article 475 of the Code of Criminal Procedure, a request for a preliminary ruling aimed at clarifying certain points of law regarding the interpretation of the following provisions: Article 216 paragraphs (1) and (2) in relation to Article 242 paragraph (10) of the Code of Criminal Procedure, namely whether the examination of a request concerning judicial review on bail requires its admission in principle, after which the magistrate assesses the merits of the request both when the measure is initially ordered and when replacing preventive arrest or house arrest with judicial review on bail.
