The Legal Issue That Generated Divergent Case Law The interpretation and application of Articles 5, 201, and 223 of Law no. 71/2011 for the implementation of Law no. 287/2009 on the Civil Code, and of Articles 6 paragraph (4), 2,512, and 2,513 of the Civil Code, in relation to Article 18 of Decree no. 167/1958 on extinctive prescription, republished, concerning the possibility for courts or parties to invoke, after the procedural moment provided in Article 2,513 of the Civil Code, the exception of extinctive prescription in cases where the prescriptive periods began under the regime of Decree no. 167/1958 and were either completed or not completed by the date of entry into force of the Civil Code—1 October 2011.
