Summary/Abstract: The High Court, deliberating on the question of law with which it was seized, notes the following: 1. The author and the subject of the referral The Galați Court of Appeal ordered, by the hearing order of 16 October 2013, delivered in case file no. 2748/91/2012 on the docket of that court, the ex officio referral of the High Court of Cassation and Justice, pursuant to the provisions of Article 519 of the Code of Civil Procedure, for the purpose of issuing a preliminary ruling on the following question of law: the clarification of the manner of interpretation and application of the provisions of Article 20 paragraph (2) of Annex No. VII, Chapter II, Section 3 of Framework Law No. 284/2010, as subsequently amended, in relation to the provisions of Article 10 of Law No. 164/2001 on military state pensions, republished, with subsequent amendments and completions, Article 40 of Law No. 19/2000 on the public pension system and other social security rights, with subsequent amendments and completions (Article 51 of Law No. 263/2010, with subsequent amendments and completions), Article 85 of Law No. 80/1995 on the status of military personnel, with subsequent amendments and completions, and Articles 1 and 2 of Law No. 119/2010.
