Summary/Abstract: The Convention on the Rights of the Child, specifically in Articles 7 and 18, places an obligation on state parties to ensure that children have the right to be nurtured by their biological parents, who are collectively responsible for their upbringing, development, and welfare. Article 47, paragraph 1 of the Constitution of the Republic of Bulgaria stipulates that the care and education of children until they reach the age of majority constitute a fundamental right and duty of their parents, which is further supported by the state. The objective of this article is to elucidate the legislative impracticality and constitutional concerns surrounding the repealed provisions of Articles 6(2) to 6(4) of the Family Code, which prohibited underage mothers from entering into civil marriage after turning 16 years old with the approval of the district court, in circumstances deemed essential.
