Summary/Abstract: The rules of application of the Social Assistance Act delegate to the director of the Social Assistance Directorate, within the discretionary power of the institution, the right to determine whether or not there are conditions for the granting of the one-time aid as well as the amount of the aid. The Director's competence is discretionary, which means that he takes a decision within the operational independence of the institution. The report examines the limits of the discretionary power of the director in administrative proceedings when the aid is granted / withdrawn.
