Summary/Abstract: The freedom to dispose of the deceased in favor of the surviving spouse, when descendants other than those resulting from their marriage or cohabitation, respectively descendants from another marriage or from the deceased's marriage, inherit, is not limited to the ordinary available quota but at a special available quota, whose minimum is variable (the part of the descendant who received the least) and whose maximum is fixed (a quarter of inheritance).
