Summary/Abstract: This work consists of the three parts. The legal and political plan of the structure of Serbia, seen especially through the recently adopted Constitution of Serbia, is beng analised in the fi rst one. It is being concluded that there are no favourable conditions for the development of an open society due to the fact that Serbia is still being arranged in a centralistic manner and, therefore, facing the lack of fundamental suppositions necessary for solving the problem of national minorites. Th e essential points of chosen documents belonging to the international community are being emphasised in the second part of this issue, to which the recommendations for the application of a constitutional position of minority communities are being suggested. Th e third part of the work deals with the importance of Serbia’s regionalism as the introduction to the creation of a democratic base necessary for the changes of citizens’ positions, including the members of national minorities as well.
