Agresorul familial

Principalul obiectiv al articolului de faţă constă în sublinierea importanţei existenţei serviciilor dedicate agresorilor familiali. Astfel, nu doar victima violenţei în familie, relaţia de cuplu trebuie să beneficieze de serviciile specializate, ci şi agresorul. Este vorba de corectarea comportamentului agresiv, precum şi demararea întregului proces de reabilitare a individului. Agresivitatea umană este extrem de complexă, motiv pentru care necesită o mare atenţie în abordarea diverselor perspective teoretice, contextuale, individuale, de cuplu, instituţionale, legislative şi morale. România încă se află la începutul construirii serviciilor specializate destinate exclusiv agresorului familial. Astfel, în Bucureşti există un singur centru care oferă servicii specializate agresorilor. Drept urmare, se fac necesare eforturi administrative, juridice şi ştiinţifice în vederea abordării problemei inclusiv din perspectiva nevoilor şi asistenţei agresorului. Tratarea eficientă a violenţei familiale implică atât victima, cât şi agresorul. De asemenea, numărul înregistrat al cazurilor de agresivitate şi violenţă, atât în spaţiul public, cât şi în spaţiul intim al familiei, s-a triplat în ultimii zece ani, datorită multiplelor eforturi ale statului de a face cunoscută această problemă şi de a oferi cât mai multe soluţii în prevenirea şi combaterea ei.

SILOVANJE U RATU - VIKTIMOLOŠKE PERSPEKTIVE

Women and children are the most vulnerable categories of sexual violence and rape in times of war. When the conflicts end mentioned categories are in numerous risks. The effects of rape in war exceed the current effects and physical attacks, but have long-term consequences. This work at the center has a victim of rape during the war. The aim of the paper is to describe and explain the normative regulation, the context of Bosnia and Herzegovina, and the consequences of rape in the war in Bosnia and Herzegovina. The work is further enriched by the victimizational profile of the victim of war-raising rape. Prevention of widespread sexual violence requires increased security in refugee camps during the war and adequate assistance, care and protection of the victim in peace. The request also includes the responsibility of the person and the state for the crimes committed against them and the provision of an open space for free expression of victimization.

Domestic violence implies any kind of violence or attack of any kind: verbal, physical, emotional, sexual as well as active or passive indifference that is being manifested over a family member by one or more persons whether they are in marital or family relationship, who live together or separated or who are divorced.Domestic violence is a huge social problem that society doesn't pay enough attention to.The biggest problem of violence in B&H is the poor punishment policy and suspended sentences of offenders. Therefore, in order to prove the above, an insight into the manuals for judges and prosecutors has been carried out, to whom the directions are given by various projects to reduce the rate of domestic violence in B&H through the criminal responsibility of criminal offenders.For the purpose of proving the mild punishment policy and inadequate punishment of criminal offenders, the analyses of sentences for criminal offenders in few FB&H courts,has been carried out.The respond of the judiciary of B&H to the cases of domestic violence, and more adequate punishment of offenders, the rate of domestic violence would be significantly reduced.

“Jack be nimble, Jack be quick…”: A Curious Existence in Emma Donoghue’s Room

Emma Donoghue’s 2010 novel presents a mother and son in confinement, locked in a soundproof garden shed. The text operates with the dichotomy of inside/outside, recognizable in such different manifestations as the son’s perception of the world, confinement and escape, and others. These dualities reflect on the novel’s most prominent issue, which is trauma as experienced by Ma and Jack, respectively. Its investigation comprises the core of the paper, which entails a careful analysis of the peculiar bond between mother and son, breastfeeding a five-year-old in confinement, and the role language plays in the novel. The analysis of these issues will ultimately shed light on existence itself as particularized in the two characters. In the novel, this existence comes to the fore through the focus on the fundamental human values that stand at the core of their personas and their connection.

Every state, as well as Bosnia and Herzegovina, exclusively through its organs, ensures the rule of law and justice. Constitutional and legal framework in Bosnia and Herzegovina, in this sense, gives the police and other state organs, authorization, but mostly oriented on precise defining of her tasks for the purpose of protection of basic rights and liberty of citizens. Police and citizens are informed about regulatory rules, about legal norms. Hence, the commitment to analyze the police law which is the subject of this paper. Police law represents the set of general legal norms which are used to regulate the safety of the state and of the citizens that live in it, and in regard to it organization, activities and control of the police, except of general legal norms which are equally related to police and other state organs, which have other particular legal branches within our legal system as their subject matter. In the paper, we used qualitative research approach with focus on application of desk method technique and historical method. As a conclusion we can say that the concept of police action has to have feeling for priorities, and has to feel responsible to exercise power only in those circumstances when it is necessary in order to providethe required level of security.

Fraud involves profiting with help unauthorized actions, procedures and tricks, often involving theft of resource, information and use assets without permission. One of the first fraud models that found its place in literature and practice was a fraud+ triangle model. The fraud triangle is a framework designed to explain the reasoning behind a worker’s decision to commit workplace fraud. The three stages, categorized by the effect on the individual, can be summarized as pressure, opportunity and rationalization. This paper reviews the concept of fraud and fraud triangle, and explain fraud triangle on the case of Bernard Madoff.

The Societal Costs of Domestic Violence – a Vector with Devastating Effects on Women

Like any social phenomenon of great magnitude, domestic violence has devastating effects on women, involving significant costs for society: direct costs (the value of services needed to treat victims of violence), social costs and economic costs. Societal dissolutions generated by domestic violence also manifest in the family structure and functions, with strong repercussions on its stability. The present study, through in-depth research into the social costs of domestic violence, aims at raising awareness of the effects of domestic violence to improve the situations that lead to a degradation of the quality of life of the human being, to a violation of the rights of women affected by any form of abuse. This study includes a comprehensive data-based analysis of services to treat victims of violence, health, quality of life, work productivity, etc. The purpose of the investigative approach was to highlight the indicators taken into account, especially the non-material ones that led to the social reaction in the immediate environment, as a necessary condition for reaching adaptation / inadequacy. The qualitative applicative research was represented by an intervention project, applied to 100 women from Caraş-Severin County. The specific techniques used were documentation, semi-structured interviews and individual counseling. Like any social phenomenon of great magnitude, domestic violence against women involves significant costs for society, physical health is impaired, mental health is endangered, self-confidence is diminished, and long-term effects are circumscribed to post-traumatic stress disorder.

THE RIGHTS OF VICTIMS OF CRIME – A COMPARATIVE APPROACH

This article analyses the comparative approach regarding the role and the treatment of crime victims in three legal systems: The Common Law adversarial system, the European continental mostly inquisitorial system and the legal system of post-socialist countries. From the literature review and the normative analysis of criminal procedure codes of different countries some interesting conclusions emerge: 1.The role of the crime victim in the criminal procedure of continental countries is well defined and organized. The rights of the crime victim, such as: the right to access to justice, the right to compensation, the right to protection and the right to assistance, all find their particular place in the continental criminal procedure, whether that is a typical inquisitorial or an adversarial one. The victim can be compensated through the civil compensation claim decided within the criminal procedure, they can participate as active subjects of the procedure with specifically defined rights, whereas the examination process of the victim as a witness is supervised by the court and minimizes secondary victimization. 2.Common Law countries have more difficulties arranging a fair treatment of crime victims: they are excluded as active subjects of the criminal procedure (they only appear as witnesses), they cannot be compensated properly within the criminal procedure, they can be subjects of secondary victimization through the aggressive cross-examination process and they are excluded from the plea negotiation process. Some efforts are made through introducing the Victim Personal Statement and the Compensation Order schemes, however, it shows insufficient. 3.Post-socialist countries are in the process of reforming their legislation regarding the role of the victim but also other issues. They need to combine the best parts of both the Common Law and the Civil Law legal systems in order to have an efficient and fair criminal procedure.

Children’s Outlook on Violence and Help

For this research, the data collection process was based on the questionnaire used by an international research conducted by The Queens University Belfast. The main aim of the research was to reveal children’s vision on violence, both from the perspective of help request and of the profile of the person offering help. The results show that for children, the most important thing is to have a person willing to listen to them and take them seriously, to offer them credibility, to act for stopping the abuse, to be patient. Also, children believe that the lack of help request is mainly due to fear. In addition, the fear that the situation might get worse and that the aggressor might find out about one’s testimony are causes presumed by children for non-testifying about one’s experiences of violence. Previous studies, however, show that the spectrum of reasons and perspectives is much broader, and the need to engage children's opinion in establishing ways to support them is increasingly obvious.

W artykule dokonano oceny stylu i sposobów oddziaływania kuratorów sądowych w pracy z dozorowanymi zakwalifikowanymi do zróżnicowanych grup ryzyka przestępczości powrotnej. Zaklasyfikowanie osób dozorowanych do grup ryzyka ma na celu poprawę bezpieczeństwa publicznego i dostosowanie rodzaju i intensywności oddziaływań kuratorów do profilu skazanych. W ten sposób powstaje możliwość dostosowania metodycznych oddziaływań kuratorów sądowych do strategii pracy ogólnoświatowych służb probacyjnych opartych na modelu zarządzania przypadkiem. W części empirycznej zaprezentowano obraz stylu i sposobów pracy kuratorów sądowych w percepcji dozorowanych. Przedstawione informacje są unikalne na tle dotychczasowych, jednostronnych analiz pracy kuratorów sadowych opartych głównie na ocenie zapisów czynności wytwarzanych przez samych kuratorów. Wykazano, że kuratorzy sądowi niezależnie od obiektu oddziaływań preferują głównie styl pośredni usytuowany pomiędzy stylem autokratycznym a demokratycznym.

The study aims to investigate financial abuse experienced by victims of domestic violence from residential centers, beneficiaries of the specialized services/ activities within the centers; an analysis has also been made regarding their employability, the difficulties they face while searching for/ keeping a job, the profile of a financially independent (former) victim, as well as the benefits of a creative workshop during the accommodation period. Responses from 48 surveyed experts were added to the perspective of domestic violence victims, as it resulted from the three focus groups organized. Results pointed to the fact that, out of 581 adult victims, only 125 had their own means of constant or occasional financial support. Most victims identified economic abuse, and the main manifestations of it, as indicated by our subjects, are: the victim’s prohibition to have a job (imposed by the abuser); the abuser is spending their money on addictions (alcohol, tobacco); workplace sabotage. To ensure their minimum subsistence wage, beneficiaries of residential centers consider they would need 1,600 RON/ month (the estimate was made in 2017), which was a challenge for most of them, considering their poor professional training. After they leave the residential center, the victims of domestic violence are still far from being financially independent and in need for further support from a multidisciplinary team.

The article assesses the style and methods of influence of court probation officers in their work with the supervised qualified to various groups of recidivism risk. The classification of supervised persons in risk groups is intended to improve public security and to adjust the nature and intensity of the measures applied by probation officers to the profile of the convicted persons. This creates the possibility of adapting the methodological measures of court probation officers to the work strategy of global probation services based on the case management model. The empirical part presents a description of the style and methods of work of court probation officers in the perception of the supervised. The information presented is unique against the background of the hitherto unilateral analyses of the work of probation officers based mainly on the evaluation of records of activities prepared by the officers themselves. It has been shown that probation officers, regardless of the object of their measures, prefer mainly an indirect style, situated between the autocratic and democratic style.

This article focuses on interpersonal relationships governing in the work environment, on psychological terror that appears increasingly in work environment, either from a superior or from co-workers. The article approaches mobbing and bossing in workplace, its origin, its various phases and its negative impact on workers as well as related transfer of feelings and moods into family, which can cause discords not only in workplace but in private life, as well. The aim is to point out the possibility of using the knowledge of social work to prevent formation, amelioration or elimination of negative phenomena which – in a long run and in unhealthy atmosphere of working environment – tend to invade privacy and affect private life of the person facing unhealthy social environment existing in his/her workplace.

In many parts of the world, mediation process is used to resolve cases of damage compensation and other non-violent cases. The opposite position is taken in Lithuania: according to Lithuanian Probation service statistic data – 245 cases of domestic violence were referred to mediation in 2018. The study investigates both innovative and relevant topic, as the mediation process between victim and offender is relatively new process in Lithuania. From a practical point of view, the relevance of the topic is that in Lithuania assistance to victim and offender is usually conducted separately, which does not mean that conflicts and problems in the family are resolved. In this case, both parties to the conflict denied the opportunity to analyze their conflict, communicate with each other in a constructive manner and seek out the causes of the conflict or develop positive relationship in the future. Without removing unpleasant emotions, analyzing emerging conflicts and identifying the causes of the conflict, domestic violence can recur. All investigations related to mediation cases of domestic violence in the Lithuanian Probation service were carried out during the implementation of the project (2014-2016), which had initiated the mediation process in Lithuania. There is only a few literature and research specifically on the topic of domestic violence in mediation, and the need for this process is due to the high number of such cases in Probation service. There is a few information sources on the development of professionals and the success of the mediation process. The main questions are: do probation officers refer suitable cases for mediation? Are reached agreements through the mediation of domestic violence cases is in the immediate environment? What are the biggest challenges of mediating domestic violence cases? How mediators could be more effective in the process? The investigation has been initiated with these problematic issues, so the main object is mediation peculiarities of domestic violence between victim and offender in Lithuanian Probation service. The aim of the study is to analyze mediators‘ experience in mediating issues between victim and offender. Focus group discussion with mediators was implemented. Content analysis of the results revealed that there are different attitudes toward victim – offender mediation between mediators. However, practitioners do believe that the process is useful and important especially for the victim. Assessing the case suitability for mediation mediators rely on their impression of the aggressor, and they apply all the principles of mediation (ex. parties‘ willingness etc.). According to mediators‘ opinion the most helpful tactics are such as individual meetings, inviting to the session of those related persons, having the reflection.The result might be useful for teachers and students of conflict management and alternative dispute resolution (mediation, negotiation). Also, for probation service mediators and officers who directly works with victims and offenders, as well as social workers, crisis center workers and for professionals who are working with families.
