VPLYV ZAPAMÄTANÉHO RODIČOVSKÉHO SPRÁVANIA NA VNÍMANÉ BEZPEČIE

Author(s): Miroslava Kopaničáková / Language(s): Slovak Issue: 4/2014

The main objective of the presented study was to determine whether there is a relationship between selected variables of perceived safety /fear of crime/ (perceived risk, perceived sense of security and preventive behavior), 3 types of retrospective parental behavior and self-efficacy. We were interested also whether there are differences in remembered parental behavior by the respondents who have experienced some kind of victimization and those who have no experience with crime. The research sample represented 265 university students (including 83 men and 182 women) with different study focus of an average age of about 22 years. The results show that if respondents perceived their parents as controlling and protective, they showed more preventive behavior, and the greater sense of perceived risk. The results showed that respondents who had experience with some kind of victimization, perceived parental behavior as less unfavorable, more emotionally warm and less hyperprotective compared with those who did not have direct experience with some kind of crime. The self-efficacy of these groups did not differ significantly.

Powrót terrorystki. Przypadek Brigitte Mohnhaupt

Author(s): Beata Łazarz / Language(s): Polish Issue: 2/2016

This article aims to analyse works from the series ‘Sympathy for the Devil?/The Wretched of the Earth’ (2008-2011) by the British artist Esiri Erheriene-Essi. The central figure is Brigitte Mohnhaupt, the German terrorist responsible for the most brutal attacks perpetrated by the Red Army Faction (RAF). Łazarz draws on psychoanalytical tools, especially ones based on the works of on Sigmund Freud and Hanna Segal. Her analysis suggests that the creation of Mohnhaupt’s portrait allowed the artist to engage in a sort of public autotherapy that made it possible to confront herself with her own emotions relating to terrorism, to become aware of ambivalence and to become empathic towards the protagonist. Her audience can participate in this experience, both consciously and unconsciously.

Smurto prieš moteris prevencija: nacionalinės teisės spragos

Smurto prieš moteris prevencija: nacionalinės teisės spragos

Author(s): Laima Vaigė / Language(s): Lithuanian Issue: 1/2016

The paper focuses on the gaps in national law in preventing repetitive violence and adopting a general strategy for the prevention of violence against women. The national legislation of the Republic of Lithuania is evaluated in relation to international law in the area of gender-based and domestic violence. Notably, Lithuania is a party to the corresponding international documents in this area. However, the national legislation at the level of laws and regulations lacks links with international law and relevant documents. The basic preventive measures are very broad and are not targeted at the elimination of violence against women; instead, they seek to decrease the numbers of crimes in the area of domestic violence. The most relevant sectors for prevention, i.e. the health care sector and the education sector, are not involved. The objectives of prevention are not placed within the gender equality paradigm, and violence against women is not seen as being connected with stereotypes and discrimination. In addition, gaps are identified in the prevention of repeated violence against women. The paper suggests that the system of protective orders should be reformed so that protective orders are available to all victims of violence and not limited to domestic violence victims. Both civil and criminal protection measures should exist, and they should be applicable to post-trial victims as well. It is also recommended that the Council of Europe Convention on preventing and combating violence against women and domestic violence, which is the most thorough document on prevention, be ratified. Ratification would improve the weakest point in Lithuanian legislation on violence against women – the prevention of violence.

IS OHS NEGLIGENCE AND EVASION AN “ERROR OF JUDGEMENT” OR “WHITE-COLLAR CRIME”? AN INTERPRETATION OF APPAREL MANUFACTURERS IN BANGLADESH

IS OHS NEGLIGENCE AND EVASION AN “ERROR OF JUDGEMENT” OR “WHITE-COLLAR CRIME”? AN INTERPRETATION OF APPAREL MANUFACTURERS IN BANGLADESH

Author(s): Muhammad Faisol Chowdhury / Language(s): English Issue: 8/2016

This paper investigates the managerial interpretation of the terms “error of judgement” and “white-collar crime” in relation to the evasion or negligence observed in administering occupational health and safety (OHS) provisions in the apparel manufacturing sector of Bangladesh. The research is qualitative in nature and follows an interpretivist paradigm. The questionnaire responses were collected from 20 mid- and top-level managers from 10 large apparel manufacturing factories located on the outskirts of Dhaka. The research reveals that all of the respondents have adequate knowledge about the relevant OHS provisions and safety protocols imposed on them by the local government and the global supply chain. They believe that the correct administration of the OHS provisions will reduce workplace accidents effectively. The research unfolds that the respondents interpret in different ways the terms "error of judgement” and “white-collar crime” in association with OHS negligence and evasion. Although empirical evidence shows that this type of negligence and evasion are considered as white-collar crime and punishable, most of the respondents in this research do not subscribe to this notion and alternatively believe that it is an “error of judgement” and therefore non-punishable.

Popkultura wobec izraelskich wzorców pamiętania o Zagładzie

Author(s): Jagoda Budzik / Language(s): Polish Issue: 03/2015

After the long period of intentional silence surrounding the subject of the Holocaust survivors in the official discourse of Israel, more and more often the Holocaust served as a justification for the Israeli military activity as well as it became a central element shaping the national identity of the Israeli Jews. This situation is directly reflected in the texts of Israeli mass culture but also has been widely criticized with the use of tools it offers. The main objective of the article is to give a brief overview of the history of this dual relationship between Israeli pop culture and the Holocaust memory, as well as to explain the special status it has in Israel from the first decades of the state’s existence until the period of an extensive presence of the topic of Holocaust memory in various kinds of popular media.

Siedmioro karłów z Auschwitz, które „Doktorowi Śmierć zawdzięczały życie”. O bohaterach reportażu Kukiełki doktora Mengele Yehudy Koren i Eliat Negev

Author(s): Agnieszka Kamińska / Language(s): Polish Issue: 03/2015

A man mistreated day after day – experiencing his own death every day for years, denigrated, beaten, threatened, with no perspectives for the future – should hate his oppressor. The story of a Jewish Hungarian family of dwarfs shows that this is not always the case. In this sketch, the author analyzes the biographical narrations of the chacters of the book, who are clearly ambivalent towards doctor Mengele. It appears that the key to the interpretation of their behavior lies in deep psychological mechanisms. The analysis of the subjects’ narrations shows that Holocaust survivors suffered until the end of their days from, what psychologists and psychiatrists have named, the posttraumatic stress disorder. As the author is not a psychiatrist, she does not discuss PTSD symptoms from a medical perspective. The aim of the study is to look at the memories presented in the book with an approach informed by the humanities and embedded in the context of psychiatric terminology. The main analytical method is hermeneutics (Prot 2009).

Author(s): Mikhail Yuryevich Chelyshev,Maria Vcheslavovna Talan,Andrey Valeryevich Mikhailov / Language(s): Russian Issue: 6/2015

The paper discusses elements of a crime encroaching on the basics of free market, fair competition. The elements and features of this type of crime, as well as the practice of applying the above-stated norm, are analyzed. Current trends in the legal policy of foreign countries concerning the field of antitrust legislation are studied. The statistical data on accountability for crimes against competition in Russia are considered. Weaknesses are identified in the legal technique of criminal legislation regarding the relations associated with the activity of economic entities. The dependence of effective law enforcement for preventing, eliminating, and restricting competition on the commensurate and adequate correlation between the norms of civil, administrative, and criminal legislation is proved. The need to strengthen the cross-sectoral links of antitrust legislation is substantiated.

Author(s): Deniz Necmettin Kaçağan / Language(s): Turkish Issue: 23/2014

In history, as it is seldom seen that a brand new project is developed, it is also rare that they are abandoned before being brought to completion. That is, the earlier projects with established foundations and accumulated knowledge are modified, renamed are placed into action again. As continuity is essential in the policies of the governments, these projects are only deferred until the right time. In this case, 50-70 years for governments is like few months in our lives. Our writings must be judged under the light of these strategic realities. In history, all terrorist organizations are organizations that were formed under the control of colonial forces and renamed as time went on. In chronological order these are: Hinchak, Dashnak, Khoyboun (Xoybûn), ASALA, PKK.

ABD İSTİHBARATINDA YAŞANAN DEĞİŞİMLER

Author(s): Sait Yılmaz / Language(s): Turkish Issue: 13/2012

Crimes against children in Gorazde during the siege 1992-1995

Author(s): Muamer Džananović / Language(s): English Issue: 5/2016

Children in war benefit from the general protection of international humanitarian law as civilians or combatants in any sort of conflict. Despite that fact, it is obvious that the Army of the Republic of Srpska during the war against the Republic of Bosnia and Herzegovina 1992-1995, highly violated fundamental rights of children by depriving them of the right to life, education, of electricity, water and food supplies, having them wounded and their home destroyed. The aggressor knew that by the commission of crimes against children a multifaceted crime was committed. In addition to the crimes against children, the crimes were committed against their parents, brothers, sisters, relatives, friends and everyone who had children and against those who could realize the gravity of such crimes.

Privacy, personal data protection and the digital age – a (criminal) law “omnibus”

Privacy, personal data protection and the digital age – a (criminal) law “omnibus”

Author(s): Jovana M. Banović,Ivana M. Radisavljević / Language(s): English,Serbian Issue: 1/2025

The Constitution of the Republic of Serbia safeguards the right to privacy through several aspects, as does the European Convention on Human Rights and Fundamental Freedoms. The cornerstone in this area is the Law on Personal Data Protection from 2018. In line with the ultima ratio principle of criminal law, the Criminal Code protects these data when the most severe violations occur, pursuant to the Criminal Procedure Code. However, with the daily expansion of science, technology, and innovative means of communication and recording, this takes on a different, “digital” dimension. Naturally, this trend calls for certain adjustments in regulations, as well as in their interpretation and application. In this paper, the authors aim to highlight key provisions of the aforementioned regulations and their current and future interpretation within the context of digital society, with a particular focus on criminal law aspects. This complexity is further amplified by the development of artificial intelligence, which inherently relies on the use of vast amounts of data. The aim of this paper is to identify some of the critical elements in the protection of privacy rights, particularly those related to personal data most closely linked to individuals, and to raise the question of potential legislative amendments.

Author(s): Nenad R. Putnik,Jana M. Marković / Language(s): English,Serbian Issue: 1/2025

The global trend of increasing urbanization and expansion of cities in recent decades has caused numerous problems in their functioning. The rapid development of information and communication technologies has emerged as a solution to these problems and led to the emergence of so-called smart cities. A smart city is conceived as a new model of a city that generates and processes enormous amounts of digital data with the aim of optimizing urban infrastructure and improving living conditions. However, the use of new technologies has raised many questions and caused concerns about the way these technologies are used and the possibilities of misuse of collected data. The paper describes the key characteristics of the smart city architecture and analyzes the issues of threats to the security and privacy of citizens opened up by it. The sources and forms of threats to security and privacy in smart cities are numerous, interconnected and require a detailed analysis from a technical-technological, sociological and legal perspective.
