სამართლებრივი შეხედულებები აჭარაში ოსმალთა ბატონობის პერიოდში

Author(s): Otar Gogolishvili / Language(s): Georgian Issue: 3/2020

The article notes that prolonged domination of Ottomans and spreading of Islam in Adjara caused introduction of completely new legal system , which was different from traditional Georgian legal norms. They started introduction of their official legal standards for making Adjara as a part of their empire. An official legal system of the Ottoman Empire was derived from Islam. Gradually, Ottomans introduced Islamic law “Sharia”. During the Ottoman domination in Adjara, “sharia” was considered to be the main legal norm.Naturally, Turkey considered this region as their own territories. So, they carried out the same reforms in this region as in the Ottoman empire. For example, Ottomans carried out Tanzimat in every occupied territories equally, which helped them to strengthen their power on the occupied territories and form Ottoman legislature. For Georgia, the most important decision was legislature about ground, whichwas activated in 1858. According to “sharia”, every muslims could have a ground for cultivation, however this property was not constant for them, because Allah was considered to be an owner of ground.

Islamic Preaching on Twitter: Mohamad al-Arefe Case Study

Islamic Preaching on Twitter: Mohamad al-Arefe Case Study

Author(s): Larbi MEGARI / Language(s): English Issue: 30 (2)/2022

This research is part of communication studies on the interplay between religion and media. It is also part of research on the use of Twitter by religious people and the use of social media in the Arab world, and more specifically the current article focuses on the priorities of Arab religious preachers in the Arab-Muslim world in their uses of Twitter. I have chosen a Muslim preacher who has been the owner of the most followed Twitter account in the Arab-Muslim world: Mohamad al-Arefe. At the time of my research, this Saudi Sunni preacher was ranked in the 83rd[1] place in the global ranking of the most followed Twitter accounts in the world. This article aims to develop a typology of content shared on Twitter by al-Arefe. This research examines the way the Twitter platform is being used by this preacher, and it answers the question whether the theoretical model of religion mediatisation applies to the content shared by al-Arefe. This article combines two methodological approaches to study the content shared by al-Arefe on his Twitter account: a quantitative method and a qualitative one. I focus on the analysis of three elements present among the contents shared by this preacher on his Twitter account: Hashtags, visuals and links. Finally, my analysis shows how al-Arefe focuses more on his person and his image than he focuses on presenting Islamic teachings.

IRAN: CAZUL MASHA AMINI ȘI CRIZA DE LEGITIMITATE A REGIMULUI AYATOLLAHILOR

Author(s): Leonard Azamfirei / Language(s): Romanian Issue: 1/2022

Masha Amini’s case is known around the world. Originally from Saquez, a town in the western province of Kurdistan, the 22-year-old woman was visiting Tehran when she was arrested by the so-called morality police on 13 September on charges of not wearing a hijab according to government standards. She was forcibly removed from her family and taken into police custody. The last moments of her life were captured by CCTV cameras in a re-education hall, where she had been sent for „guidance” on her attire. She fell into a coma in the detention centre and although she was taken to hospital, doctors could do nothing to save her life.

ISELJAVANJE KRŠĆANA IZ BOSANSKOG EJALETA (1683-1718)

ISELJAVANJE KRŠĆANA IZ BOSANSKOG EJALETA (1683-1718)

Author(s): Ramiza Smajić / Language(s): Bosnian Issue: 8/2022

The end of the 17th and the beginning of the 18th century was marked by radical changes on the demographic map of the Bosnian Eyalet as a serhat of the Ottoman state. In addition to mass migrations of the Muslim population from the lost Ottoman territories towards the interior of the Bosnian Eyalet, there were also continuous movements of the Christian population in the opposite direction. The paper follows the movements of some groups of Christians, mainly those who respond to the bishop's call to settle the desolate areas around Pécs, Szeged, Baja and the surrounding area, but also the migration of other non-Muslim populations towards the Venetian territory, as well as migrations to the „Imperial lands“ due to various political, economic and other factors. While the Venetian government encouraged, with money and investiture, the people to bring families to Dalmatia, and the Austrian government received petitions from the priests of Bosnian monasteries about the difficult situation of Catholics, the Ottoman government throughout that time undertook activities to stop defections, therefore, the paper describes some of the procedures and the situations themselves. Some authors exaggerate when they say that, for example, between 100 and 200 thousand Catholics left Bosnia. The paper shows that according to some reports, 74 thousand Catholics lived in Bosnia before 1683, and 25 thousand half a century later. This is an acceptable number of emigrant Catholics compared to the exaggerations of some chroniclers. An important part of the work is the knowledge obtained from sources, who actually are the non-Muslims that go across the border from the interior and from the borders of the Bosnian Eyalet. Ottoman sources usually refer to both Catholics and Orthodox by the name „kefere“ (a collective noun denoting the non-Muslim population in general). For the Ottoman administration, the most important thing is that it is a category of non-Muslims in order to tax them according to that category. Due to such a situation, it is difficult to give a definitive number of Catholics or Orthodox in a certain period according to Ottoman sources. In the paper, we provide a limited analysis of the case according to some unpublished sources, so it can be seen how many Christians, heads of the household, remained in a certain area. Often, however, it is not possible to know whether they are Orthodox or Catholics, because there are no priests among them. Names are often a problem, too, because patronymics are rare, and names can be tied to a nomenclature common to both Catholicism and Orthodoxy. From the episcopal and friar reports, it can be seen that in that period, the conversion of Muslims also took place, so among the migrants to the north, for example, there were thousands of new Christians. The cities of Požega, Osijek and Brod also lost their Muslim population and hundreds of Catholics from Sarajevo, Kreševo, Modriča and Vrhbosna are coming to them. Registry books record their origin, especially in the first years of the 18th century. The Orthodox and Catholic population from the Herzegovina Sandžak settles mainly in the Boka Kotorska area. An extensive cadastral census from 1701 shows that among the people there are many who come from places that are not affected by war activities. The Orthodox population from Backa and Baranja goes to Slavonia and Srijem, but also to Ottoman territory. On the territory of the Republic of Dubrovnik, war refugees from the Bosnian ejalet are most often Vlachs, especially during the periods of the Moravian War (1684-1699) and the Venetian-Ottoman War (1714-1718). The Ottoman authorities demanded that these people be delivered to them, and the Dubrovnik authorities formally agreed, but they often helped the people to stay there or to go further by sea.

RELIGIJSKO I OPĆELJUDSKO BRATSTVO. MUSLIMANSKO STAJALIŠTE O TREĆOJ ENCIKLICI PAPE FRANJE FRATELLI TUTTI

RELIGIJSKO I OPĆELJUDSKO BRATSTVO. MUSLIMANSKO STAJALIŠTE O TREĆOJ ENCIKLICI PAPE FRANJE FRATELLI TUTTI

Author(s): Nedžad Grabus / Language(s): Bosnian Issue: 2/2022

In this work, we deal with the basic postulates and the common question of brotherhood and sisterhood based on the encyclical of Pope Francis, Fratelli tutti, “We are all brothers and sisters”, the content of which, as is written in the introduction, was inspired by meetings with Sheikh Al-Azhar Ahmad Al-Tayyib. Al-Azhar University has a distinguished reputation among a majority of Muslims around the world. The Pope refers to Saint Francis of Assisi, who, inspired by the content of the New Testament, addressed these words to all people: brothers and sisters, men and women, all people of good will, God’s creatures. We examine the links between the faiths and why it is important to read the Pope’s encyclical as an incentive to accept the other, to accept differences and to develop a culture of dialogue; and the implications the encyclical has for theological dialogue, ethical monotheism and social justice. The encyclical has a clear link to the Document on Human Fraternity for World Peace and Coexistence that Pope Francis and Sheikh Al-Azhar Ahmad Al- Tayyib signed on February 4, 2019 in Abu Dhabi. In this text, we are primarily interested in the parts that indicate the necessity of developing and nurturing a culture of dialogue and accepting believers as brothers and sisters, and the importance of ethical monotheism, which strongly unites all followers of monotheistic religions. Three segments are important to us in our work: the theological openness of the Pope’s third encyclical, ethical issues and social context, and populism and liberalism. These questions are also important for our area, considering the centuries-old intertwining and common life of Christians and Muslims in this part of the world.

Izvan metafizičke idolatrije: Mulla Sadra o mentalnim konstruktima Boga

Izvan metafizičke idolatrije: Mulla Sadra o mentalnim konstruktima Boga

Author(s): Mohammed Rustom / Language(s): Bosnian Issue: 28/2023

The famous Islamic philosopher Mulla Sadra wrote numerous works on the interpretation of the Qur’an. In one of the works, entitled Tafsir of surah al-Fatiha, he contemplates the nature of idolatry, especially the metaphysical one, in the light of religious belief. There he actually discusses in details the deceptiveness of mental constructs that lead to idolatry. In the first part, he discusses the constructs, while in the second part he writes about the religion of a perfect man who is able to see God in every form, in every image and in every point of view. Sadra’s reflections often reveal Ibn Arabi’s influence. At the end, there is a selected glossary of key terms in the Mulla Sadra’s work.

Alevî-Bektaşî Menâkıbnâmelerinde Renk Sembolizmi

Alevî-Bektaşî Menâkıbnâmelerinde Renk Sembolizmi

Author(s): Sümeyye Yurduseven / Language(s): Turkish Issue: 3/2023

Manākibnāmes, which include the wise words and virtuous behaviors of the Sufis in the Sufi literature, are written to explain the miracles of the elders of the sect; the political, social, and religious-mystical structure of the society; It is one of the important sources of the world of culture and literature because it contains the historical events and personalities of the age. The inclusion of the miracles of the saints in the Alawī-Bektashi manākibnāmes has caused these works to be quite rich in terms of symbolic motifs. The colorful motifs in the velayetnames such as Koyun Baba, Demir Baba, Seyyid Ali Sultan and the legends such as Abdal Musa and Hacım Sultan, reflecting this culture, especially in the Velayetname of Haci Bektash revealed the necessity of examining the subject in detail. These colors constitute an important area both in understanding the Alawī-Bektashi culture and in the analysis of the Turkish-Islamic unity in the formation of this culture. Turkish, Ottoman, Arabic, and English works were used in the research. By finding information about the subject, its symbolic meanings were evaluated. The information obtained was organized in accordance with the subject headings. Many studies have been done on manākibnāmes. However, there has not been a direct study on the color symbols in the manākibnāmes and the semantic background of these symbols. For this reason, the motifs in the manākibnāmes were examined in this study. Information about the color symbolism of these motifs is given on the axis of old Turkish belief and Islam.

Kurtubî’nin Morfolojik Temelli Anlam Arayışı

Kurtubî’nin Morfolojik Temelli Anlam Arayışı

Author(s): İsmail Erken / Language(s): Turkish Issue: 3/2023

As an Arabic term sarf, morphology; is the science of creating a new or similar structure from the main form in terms of meaning and with appropriate transformations or additions to what is meant to be expressed and examining the words formed in this way. The Qur'ān, revealed in Arabic to being understood, also becomes the subject of Arabic linguistics and sarf. While interpreting the Qur'an, commentators, and linguists have also benefited greatly from the science of morphology. Abū Abdallāh Muḥammad b. Aḥmad al-Qurṭubī (d. 671/1273) used morphology to understand and explain in al-Jamī' li-'Aḥkām al-Qur'ān. One of the most distinctive features of his tafsir is that philological explanations, including morphology, are included in the explanation of the ayah. Qurṭubī made a structural analysis of the words in the verse and gave morphological information about them, and he dealt with the details and exceptions in terms of form. Considering the morphological situations of words, he tried to make the meanings of words understandable. However, another issue that should be emphasized during the research is that Qurṭubī reaching meanings that cannot occur with these rules by moving from the rules of morphology. It is noteworthy that Qurṭubī made these applications in cases such as the characteristics of the wording, the differences in reading, the context in which the word is found, za’id (excess), hazf (reduction), etc. The study has been limited by reviewing the information Qurṭubī gave in the process of understanding and explaining the ayahs and based on his comments on singular-dual-plural, masculine-femininity, and certainty-uncertainty, which are among the subjects of morphology. In these three subjects, research has been done in tafsīr, the subject has been studied through examples related to the subjects, and explanations, evaluations, and assumptions have been made about the subject. In this study, the samples were examined in detail by considering them from different angles, and the subject was conveyed in a way that focused on the meaning.

Przyszli w imię religii. Państwo Islamskie w percepcji mieszkańców północnego Iraku

Author(s): Łukasz Fyderek / Language(s): Polish Issue: 22/2022

This article reconstructs the perception of the Islamic State by the inhabitants of Northern Iraq, who in the years 2014–2016 lived under the rule of this quasi-state. This is a descriptive case study based on field research in Northern Iraq. It analyzes the perception of the peculiar, fundamentalist state-building process. The main findings point out that the population of Northern Iraq initially perceived IS as a legitimate organization, mostly due to their religious credentials. Over time, under the IS rule, this perception changed into a negative one. The article identifies the main challenges of the administrative apparatus and the survival strategies of the inhabitants of Northern Iraq under the rule of a fundamentalist quasi-state.

LA GÉOMETRIE, LA SPIRALE ‘AL-HALAZUN’ ET LA GLORIFICATION DE LA NATURE POUR L’AMOUR DIVIN

LA GÉOMETRIE, LA SPIRALE ‘AL-HALAZUN’ ET LA GLORIFICATION DE LA NATURE POUR L’AMOUR DIVIN

Author(s): Sofia TABARI / Language(s): English Issue: 1/2022

Without orthogonality and without visible axiality, in appearance the garden of Algiers of the Ottoman period does not follow any geometry, it presents itself on a sloping ground with grass, flowers and fruit trees following the logic of the cultivator who has respected the movement of the sun, the cultivation techniques and the irrigation system. It seems like a natural landscape whose vegetable, ornamental and medicinal plants, coexist by means of highly developed cultivation techniques. The absence of apparent geometry certainly gives a natural character to the garden and a great feeling of pleasure. However, it is on the basis of a circular and spiral geometry that a spatial hierarchy of the garden is ordered to give a spiritual and mystical meaning to the garden. Thus, it is from the forest towards the orchard, then towards the courtyard and finally towards the patio that the passage from nature to culture is felt. This garden, described as picturesque by historians, travelers and painters of the modern era, tells of the love of man for his creator, a relationship that the poets and painters of medieval and modern Islamic times have admirably represented. This paper contains a cross-reading of the medieval Islamic painting and of the architecture of the Ottoman Garden of Algiers, which represent depictions of the love of man towards his creator through the geometry of the spiral, a geometry that is both cultural and natural.

UNPACKING THE TALIBAN: A HYBRID OF DELINQUENT SANCTIMONY

UNPACKING THE TALIBAN: A HYBRID OF DELINQUENT SANCTIMONY

Author(s): Ahmad Shayeq Qassem / Language(s): English Issue: 1/2023

Since its inception in 1994 as an organised group or network with a claim on rulership of the country, the Taliban has been generally described as an “Islamic movement” committed to the implementation of sharia in Afghanistan. Such description may accord well with the group’s professed objective but reveals itself reductive at best and misleading otherwise on closer scrutiny. This article argues that the “Taliban” represents a hybrid phenomenon that deploys religious and political narratives just as it deploys organised crime in pursuit of maximum power and profit.

HOW AL-QAEDA AND ISIS EMPLOYED MEDIA? A COMPARATIVE STUDY

HOW AL-QAEDA AND ISIS EMPLOYED MEDIA? A COMPARATIVE STUDY

Author(s): Aiman Abboushi,Sharifah Hayaati Syed Ismail al-Qudsy,Amer Abdulwahab / Language(s): English Issue: 1/2023

Terrorist movements express their discourse through messages, which they are keen to send a specific state or people or the whole world. However, terrorist blasts are not the only message, but rather ideological reasoning accompanies every terrorist act. This was clearly observable in the discourse of Al-Qa’eda, especially as the group tried to rely on considerable grievances which cannot be denied. Al-Qa’eda has a wide and accumulated experience in turns and events, which make it a phenomenon worthy of study. With the development of Al-Qa’eda’s experience, the Islamic State of Iraq and Syria’s power, speed of spread, ascendancy and brutality since it took control of Mosul without noticeable resistance on June 20, 2013 has been remarkable. This moment was a point of transformation in the media’s view of the organization. And it becomes clear that any of both organizations will not be sustainable so long as they lack justifications considered reasonable by outside observers and lack grievances to push their soldiers to recruit youth and convince them with their media arguments.

THE PALESTINIAN ISSUE IN THE MEDIA DISCOURSES OF TERRORIST ORGANIZATIONS

Author(s): Adel Salama,Sharifah Hayaati Syed Ismail al-Qudsy,Osman Rasip,Amer Abdulwahab / Language(s): English Issue: 1/2023

This article examines the extent to which the Palestinian issue is exploited to promote cross-border terrorist movements. The analytical descriptive approach is employed to explore the evolution of the terrorist organizations, and trace the ideology, means, and content of their media discourse. The article reveals that the extremist groups utilized the value, sanctity, and nobility of the Palestinian issue to influence Arab and Islamic societies in an attempt to give legitimacy and credibility to their presence, media discourse, and terrorist acts; disseminate their extremist ideologies; rally support and recruit new elements, and emotionally influence the public perception. The article also concluded that these terrorist organizations refrained from targeting the Israeli occupation and opposed the Palestinian national narrative about the national and political nature of the Palestinian struggle.

TERRORISTS OR LEGITIMATE INSURGENTS? THE TALIBAN STATUS UNDER INTERNATIONAL LAW

TERRORISTS OR LEGITIMATE INSURGENTS? THE TALIBAN STATUS UNDER INTERNATIONAL LAW

Author(s): Fawad Poya / Language(s): English Issue: 1/2023

The term terrorism is not subject to a universally accepted definition. However, it is generally used to describe the use of violence against civilian targets to spread fear and distress and thereby achieve ideological and/or political objectives. Specific acts of terrorism, whether national or international, have been proscribed by respective laws. The Taliban’s return to power in Afghanistan after Kabul’s collapse in August 2021 has raised an important question: are the Taliban different from other terrorist organizations (e.g., al Qaeda, ISIS)? This debate is significant because the groups share ideological similarities and execution practices; and at present, the Taliban face challenges of both intent and capability vis-à-vis ceasing acts of terror and ending ties with other terrorist organizations. This paper argues that the lack of a universally agreed definition of terrorism may not affect the investigation and prosecution of the Taliban’s terrorist offenses. In this regard, this paper critically appraises three factors—accountability, ties with terrorist organizations, and the inclusion of Taliban members’ names in the global sanctions regime. It also demonstrates why the international community is obligated to take both legal and ‘non-legal’ actions against the Taliban to avoid the normalization of terrorism.

Ile jurysty w Piotrze Czyżewskim? Uwagi o prawie rzymskim w Alfurkanie tatarskim, siedemnastowiecznym paszkwilu na litewskich Tatarów

Author(s): Kacper Żochowski / Language(s): Polish Issue: 8/2022

Alfurkan tatarski prawdziwy na czterdzieści części rozdzielony (A Genuine Tatar Al Furqan Divided into Forty Parts) is a pasquinade on the Lithuanian Tatars written and published in the seventeenth century. Although it was published in Vilnius under the name of Piotr Czyżewski, there is a continued discussion as to who described the Tatars’ history, customs and position by placing them in a broad context, including a historical and legal one. The arguments presented in the Alfurkan he illustrated with examples from the works of ancient and medieval authors, including references to Roman law. The article attempts to answer to what extent those references were done accurately and with understanding. Thus, the article’s author first identifies the ancient legal content present in the Alfurkan; then, he considers the question of what the errors, manipulations and the specific choice of sources say about the Alfurkan’s author.

RELIGIOUS MIXED MARRIAGES IN KOSOVO

RELIGIOUS MIXED MARRIAGES IN KOSOVO

Author(s): Angjelina Hamza Hasanaj / Language(s): English Issue: 21/2021

The paper deals with an interesting social phenomenon, which is at the same time a sensitive issue and refers to marriages between Albanians of different faiths: Christian Catholics and Muslims. During the elaboration of the topic, materials were collected through field research conducted in several villages and towns in Kosovo. The text aims to offer a specific approach to mixed marriages, especially when it comes to two different religions, and to see the general norms that arise from a religious point of view. Тhe current research on mixed religious marriages in Kosovo recognizes the period after the Second World War as the period when most religious mixed marriages took place and marriages between members of different nationalities. In Kosovo, in the socialistic period when it was part of SFR Yugoslavia, intercultural, economic, and social communication developed between the various groups living in the area. It was a period of a severe general crisis, a period when the vast migration from village to city began, mainly due to economic reasons and the need for labor, which, in addition to employment, created conditions for more significant social emancipation and modernization of society, which contributed people to meet, mingle and enter into mixed marriages.

МЕЃУВЕРСКИ БРАКОВИ ВО КОСОВО

МЕЃУВЕРСКИ БРАКОВИ ВО КОСОВО

Author(s): Angjelina Hamza Hasanaj / Language(s): Macedonian Issue: 21/2021

Author(s): Aidar Yu. Khabutdinov,Marina Maratovna Imasheva,Mileusha M. Khabutdinova / Language(s): Russian Issue: 1/2023

The article discusses the process of formation and development of the sociopolitical movement of Muslim women (Tatars) in the Volga-Ural region during the revolutionary events of 1917. At the beginning of the 20th century Russian society believed that Muslim women did not have the opportunity to participate in public life, and their interests were traditionally limited to the family. However, the residents of the Volga-Ural region did not share this point of view. In fact, since the beginning of the 20th century, the development of the social movement among Tatar women was quite different from the development of the social movement among other Muslim peoples of Russia. It was characterized by the presence of a middle class in urban Muslim communities, within which various forms of inclusion of women in society were institutionalized, and the events of the 1917 Revolution led to their final formation in the regional and national contexts. The main novelty of this article lies in the fact that, based on the analysis of a wide range of sources, it became possible to analyze the position of Tatar women on the development of their civil and political rights, participation in national bodies and self-government bodies in 1917.

Роман Ф. М. Достоевского «Преступление и Наказание» в контексте Священной истории: Авраам, Христос, Магомет

Author(s): Valentina Vasilievna Borisova / Language(s): Russian Issue: 4/2022

The article presents a detailed commentary on the famous statement of Rodion Raskolnikov, which actualizes the ambivalent semantics of the images of the “trembling creature” and the prophet. As the results of the narrative and textual analysis of “Crime and Punishment” show, this feature of word usage makes it possible to differentiate between the positions of the author and the hero. The article also proves that in the canonical text by Dostoevsky Raskolnikov’s thought is framed as a “foreign word,” graphically and punctuationally marked, as indicated by quotation marks, italics, an initial colon and an exclamation mark at the end. In the quoted text, Raskolnikov’s exclamation and the direct speech of the prophet in the interpretation of the hero of the novel alternate twice. The article shows how the author exposes his position to crushing “plot criticism,” debunking Raskolnikov’s religious and moral mistakes, including the opposition of Christ to Mohammed, which the author eliminates in the epilogue of the novel by mentioning Abraham, “the father of all believers.” His figure is a key one in the system of historical and spiritual kinship of the three world religions. In the context of anthropology and genealogy of the Sacred History, Raskolnikov’s last vision symbolizes his return to the “bosom of Abraham.” The hero, like a prudent robber in one of the variants of the iconographic plot, seems to be next to the “forefather.” As a result of the conducted historical, cultural and textual analysis, the author concludes that Dostoevsky, following Pushkin, reproduced the effect of the hero’s co-existence with the main figures of Sacred History in his novel.
