The theoretical views of Prof. Ivan Kinkel on the economic history are presented and analyzed. He established an original concept on the systematic presentation of the periods of the global economic development, dividing it in three cultural civilization cycles, each having four consecutive forms. The so called Malthusian Law is also considered in an original way. He intends to use it as a theoretical framework to analyse the past. The scientific weight of the theoretical views of Prof. Kinkel is somewhat discredited by his proximity to left and right totalitarian ideologies and by the scientific propaganda of the ideas of race hygiene and Eugenics.

The paper examines interpretation as a logical method for finding true meaning and reach of legal norm which method falls outside scope of legal regulation. In the context of term „interpretation of law“, it is only one sub-category of a very complex and varied appearance of interpretation in general. In addition to relevant interpretations, the paper analyses interpretation of norms of criminal procedure law and meaning of principled legal positions. The central part of the paper concerns the Constitutional Court of Bosnia and Herzegovina as an interpreter of the Constitution of BiH. In that regard, although provision of Article VI(3)(a) of the Constitution of Bosnia and Herzegovina does not provide for explicit jurisdiction of the Constitutional Court of BiH to review constitutionality of the laws or provisions of the law of Bosnia and Herzegovina, a substantional term of authorizations specified by the very Constitution of Bosnia and Herzegovina contains in itself a legal basis for the Constitutional Court for such jurisdiction and especially by the role of the Constitutional Court as authority that upholds the Constitution of Bosnia and Herzegovina. The position of the Constitutional Court in such cases in its current case-law clearly indicates that the Constitutional Court has jurisdiction to review constitutionality of the laws or certain provisions of the laws of Bosnia and Herzegovina.

UPOREDNOPRAVNI PREGLED DIVORTIUMA U ANTIČKOM RIMU, RAZVODA BRAKA U KANONSKOM PRAVU I ET-TALAQ U ŠERIJATSKOM PRAVU U ODNOSU NA POZITIVNO BRAČNO PRAVO

Rezeption des römischen Rechts hatte einen großen Einfluss auf das Eheecht der Länder, die zum juristischen Kreis des Kontinentaleuropa gehören. So hatten viele Institutionen, wie zB: divortium, caelebs, orbus, matrimonium, concubinatus usw. einen großen Einfluss und entscheidende Bedeutung bei der Erarbeitung moderner rechtlicher Kodifizierungen, die das Eherecht regeln. Genauso wie dieser Prozess im westlichen Teil von Europa verlief, hatte das römische Recht seinen Einfluss auf das Gebiet des Westlichen Balkans durch die Bürgerlichen Gesetzbücher erweitert. Trotz des großen Einflusses des römischen Rechts auf das eheliche Recht der europäischen Länder, dürfen wir den Einfluss von anderen Rechtsordnungen auf unser privates Recht nicht vernachlässigen. Zu diesen Rechtsordnungen gehört der stärkste Einfluss der religiösen Rechte, die bis Mitte der vierziger Jahre des letzten Jahrhunderts für Muslime das positive Recht in diesen Bereichen waren, und von staatlichen Institutionen angewendet wurden. Daher sollte der Gesetzgeber alle Umstände berücksichtigen, die eine Gemeinschaft im Laufe der Zeit beeinflussen, und im Sinne der Achtung der universellen Menschenrechte und der Freiheit, Gesetze erlassen, die für Menschen von großem Nutzen sein werden, insbesondere bei der Regelung von Familien- und Eherechten. Schwere und dauerhaften Störung der ehelichen Beziehung, die zu Intoleranz des Zusammenlebens führt, wird als Grund für die Scheidung in allen drei Familienrechtsgesetzen in Bosnien-Herzegowina angeführt. Auf der anderen Seite konkretisieren das kanonische Recht der katholischen und orthodoxen Kirchen und Scharia diese Gründe, die in der Regel, wie auch positivrechtlich normiert, die Ursache für eine schwere Unverträglichkeit des gemeinschaftlichen Lebens sein werden, und die das Gericht in jedem einzelnen Fall zu beurteilen hat.

METHODEN DER AUSLEGUNG IM INTERNATIONALEN VERTRAGSRECHT

Der Vereinheitlichung des Vertragsrechts kommt man immer näher. Ausserhalb der Europäischen Union hatten bislang die UNIDROIT Grundregeln die höchste Anwendungsquote. Dabei handelt es sich um Prinzipien, die von Sachverständigern ohne staatlichen oder überstaatlichen Auftrag oder Ermächtigung ausgearbeitet wurden. Ziel war die Zusammenstellung einheitlicher Grundsätze durch Vergleich und nötigenfalls Fortbildung der nationalen Rechtsordnungen. Auch im Rahmen der Europäischen Union hält die Europäische Kommission eine weitreichende Harmonisierung für notwendig. Das Europäische Vertragsrecht soll vereinheitlicht werden, um den grenzüberschreitenden Handel und damit den Binnenmarkt zu fördern. Favorisiert wird die Idee eines optionalen europäischen Vertragsrechts, somit wird es zum Teil von “lex mercatoria”. Das Ergebnis dieser Aspiration ist der Vorschlag einer Verordnung für ein Gemeinsames Europäisches Kaufrecht vom 11.10.2011. Diese Arbeit stellt die Instrumente, die der Vertragsunifizierung dienen, dar. Danach wird die Auslegung der Veträge in den UNIDROIT Prinzipien und den Vorschlag der Verordnung bearbeitet, und dessen Bestimmungen verglichen. Untersucht wird das bosnische Schuldrecht, sein derzeitiger Bestand im Bezug auf die Vertragsauslegung und im Vergleich mit den oben genannten Instrumenten, da Bosnien und Herzegowina die Mitgliedschaft der Europäischen Union anstrebt.

IN MEMORIAM: dr. Ibrahim Festić, redovni profesor

Dr. Ibrahim Festić rođen je 2. maja 1939. godine. Čitav svoj radni vijek posvetio je izučavanju pozitivno šire definicije upravnog prava. Po tom shvatanju nije moguće uspostaviti oštru razliku između ustavnog i upravnog prava. Prvi njegov rad u toj naučnoj oblasti bila je doktorska disertacija „Organi uprave u skupštinskom sistemu vladavine s posebnim osvrtom na SFRJ“. Danas, nakon 42 godine od njegove odbrane, taj rad može biti predmet pravne historije u Bosni i Hercegovini. Nakon odbrane i izbora u docenta 1971. godine, bio je član Komisije za izradu Ustava Socijalističke Republike Bosne i Hercegovine 1974. godine. Od tada do danas ostao je dosljedan u izučavanju ustavnog prava. Pri tome je uvijek vodio računa da ne izgubi kontakt sa upravnim pravom. U tome je uspio koliko su mu dozvoljavale društvene okolnosti u kojima je živio i radio. To pokazuje i monografija „Raspodjela nadležnosti između Federacije i federalnih jedinica“.

BIH STATEHOOD AND SOVEREIGNTY OF ITS CITIZENS

General Framework Agreement for Peace in BiH or BiH Constitution from 1995. resulted in radical constitutional changes in a way that it introduced two entirely new categories into BiH constitutional system: entities and constituent peoples. By their constitutional positioning, the core values, rights and interests of the state of BiH and its citizens were questioned. The points of views, that are denying BiH statehood and sovereignty of its citizens, appeared. Such attitudes are generally not based on science, or positive law, but they have a great impact in the creation of socio - political relations in BiH. Analysis of the BiH Constitution and decisions of the BiH Constitutional Court confirms the unbreakable connection of BiH statehood and sovereignty of its citizens. The quantity of entities’ competence and rights of the constituent peoples do not give them the qualities possessed by BiH and its citizens related with statehood and sovereignty.

Functioning of state depends, among other things, on constitutional norms on organization and decision-making methods of state institutions. These issues are not always adequately regulated. Therefore it is possible to have different interpretations of constitutional norms which affect functioning of state institutions. In this article the author analyzes parts of materia constitutionis which are incompletely or unclearly regulated, different methods of their interpretation and consequences which they produce on functioning of institutions. Parts of materia constitutionis which are differently interpreted are: human rights, division of jurisdiction, legislative and executive power, constitutional basis for creation of state judicial institutions and Constitutional revision.

The constitutions of most countries have an introductory part - the preamble, which leads the normative part of the constitution. Preambles often contain general rules and principles on which the state is founded, then the basic human rights and freedoms, social aims and national development, such as sovereignty, independence, integrity, democracy, rule of law, liberty, equality. Sometimes constitutions themselves resolve the question of the legal nature of the preamble, but if that is missing - form and content of the preamble determine its legal nature on which depends constitutional-legal binding force of the preamble. Preamble is an integral part of the Constitution of Bosnia and Herzegovina and can have a normative character. According to the decision of the Constitutional Court number U 5/98, preamble can be seen as an act which through the entire Constitution includes normative principles and values. However, the impact of certain sentences of the preamble to the interpretation of the Constitution is not the same, because all the sentences don’t have the same normative value. The fact that the text of the preamble is not only secondary method of interpretation, for the Constitution of Bosnia and Herzegovina is very significant.

Der integrierte Konzeptualismus der gesellschaftlichen Beziehungen schätzt die Einflüsse im Bestehen des Gesellschaftsbereichs und die Interessen bei der Herstellung der bürgerlichen Beziehungen und durch diese Methode und dieses Vorgehen zieht er eine Demarkationslinie zwischen der Gesellschaft und den bürgerlich strukturierten Phänomene. Die Gesellschaftstheorie beachtet die Tatsache, daß die bürgerlich strukturierte Perspektive zur Rechtfertigung deren Funktionalisierung die zweckmäßigen Standpunkte schafft! Aus der Erkenntnis der Art und Weise wie die bürgerliche Perspektive strukturiert, funktionell selbstermöglicht und perpetuiert wird, das heißt, aus der wahrnehmenden Relevanz der in der Gesellschaft selbst involvierten bürgerlichen Widersprüche entsteht die Tatsache, daß die Irrationalität des bürgerlichen Systems und der Ordnung die bürgerliche Gesetzmäßigkeit mit deren Bestimmungen durch die Art der bestimmenden Widersprüche und Verneinung der Gesellschaft selbst überordnet, und daß das Forschungsverfahren der Gesellschaftstheorie durch minuziöse Erkenntnis der bürgerlichen Strukturierung und Konstituierung der Beziehungen die gesellschaftliche Gesetzmäßigkeit sichert und feststellt.

The objective cumulation of lawsuit claims is a processing institute, which allows a plaintiff to propound multiple claims against the same defendant or multiple defendants in one suit or during litigation. This paper discusses possible ways of establishing objective cumulation, different kinds of objective cumulation, criteria for distinguishing certain types of objective cumulation, rules of procedure of the court when it comes to the possible cumulation, the application of any accumulation in case law, occurrence of litigation when it comes to objective cumulation, cases where there is an objective cumulation, determination of the value of the dispute in relation to the cumulative lawsuit claims, procedure of first-instance court in the case of objective and subjective cumulation, procedure of appeal court judgment against the defendant’s first instance judgment upholding the eventual application, procedure of appellate court in the case of simultaneous accumulation of objective and subjective claims, when only the defendant complains on subsidiary adjudging eventual request, a critical review of the current legal solution regarding accumulation of objective proposal de lege ferenda.

This paper analyses various aspects of compensation, as one of the essential elements of a license agreement. The compensation (license fee) is the equivalent for the right to use the intellectual property rights, and is the main reason why the holder of the patent, trademark, industrial design, know how, integrated circuit topographies and plant breeders rights decides to transfer them to others. The Law of Bosna and Herzegovina does not prescribe gratis (free) licenses, and since a need to for such a contract may occur in practice, it is suggested that they should be regulated de lege ferenda. In order for the license agreement to meet the economic interests of both parties, the fee must be optimally determened. There are a number of ways to determine the license fee, which are dealt with in this paper. Lump-sum payments can be payed at once or partially, royalties can be connected to sale, profit or production, and it is also possible to combine lump-sum payments and royalties. Cross-licensing involves the exchange of industrial property, and is one of the specific forms of payment which large companies prefer.

Opšta načela međunarodnog prava dio su pravnog poretka Bosne i Hercegovine i entiteta po sili državnog Ustava. Jedno od tih načela, koje ima poseban značaj i težinu u situaciji kada se Bosna i Hercegovina nalazi u procesu evropskih integracija, je načelo pacta sund servanda. Riječ je pravilu načelnog/principijelnog karaktera koje je usmjereno na konsekventno i dosljedno izvršavanje obaveza međunarodno-pravnog karaktera, odnosno obaveza iz međunarodnih ugovora koje je država zaključila ili kojima je pristupila, čije neizvršavanje i/ili kršenje može dovesti do odgovornosti države stranke po međunarodnom pravu. Izvršavanje tih obaveza u slučaju Bosne i Hercegovine, međutim, ujedno predstavlja obavezu po unutrašnjem pravu, odnosno po njenom Ustavu. Takva pravna situacija nameće obavezu za nosioce vlasti na svim nivoima njene organizacije, koja se zasniva na Ustavu, u pogledu izvršavanja obaveza međunarodno- pravnog karaktera što je, u konačnom, činjenica koja presudno može opredijeliti dinamiku i modalitet provođenja reformskih procesa u Bosni i Hercegovini.
