Mediation is an ADR which falls within the category of means of self-determination and which presupposes the intervention of a third party a mediator whose functionis to bring the parties together in a dispute in order to conclude an agreement between them. In the Portuguese legal system, it is not possible to mediate disputes between taxable persons and the Tax Administration. There are several obstacles to the mediatability of litigation in tax matters. In particular, we are thinking about the principles of legality, the unavailability of the tax credit, and equality. In this paper, it is sought to ascertain if these obstacles are absolute, not allowing any openness to the legality of legal-tax disputes, or if, on the contrary, they are not absolute, making feasible the thinking of creating a relation between Law Taxation and mediation. Adopting a method based essentially on dogmatic analysis, it is believed that it is possible to recognize the legality of legal-tax disputes, albeit within certain limits. The mediation will allow a closer approximation between the parties - taxable person and the Tax Administration - thus contributing to the creation of a greater ethical-tax awareness and, in this way, to the reduction of litigation.

The issue of legality of unilateral humanitarian intervention in con¬temporary international law gives rise to significant difference in opinions among states and scholars. It is primarily due to the fact that the international treaty law contains no rule which explicitly allows or prohibits this kind of intervention. In this legal situation, in order to explore the legality of unilateral humanitarian intervention, we need to analyze the provisions of relevant international treaties and international customary law. The most important international treaty for assessing the legality of unilateral humanitarian intervention is the UN Charter. Article 2(4) of the UN Charter prohibits the threat and use of force, except in case of self-defense or upon the Security Council authorization. Given that unilateral humanitarian intervention does not fall into these exceptions, it constitutes a violation of Article 2(4) of the UN Charter. The fact that the Security Council did not act in cases involving mass or serious human rights violations does not allow states and international organizations to take unilateral military action and breach the aforementioned prohibition of the use of force. Beside the UN Charter, the IHL and human rights treaties are also important for assessing the legality of unilateral humanitarian intervention. Although these treaties envisage many forms of international control over the observance and implementation of human rights, none of treaties allows for the use of armed force in case of human rights’ violation, even in situations involving large-scale violations of human rights. For the purpose of assessing the status of unilateral humanitarian intervention in international customary law, it is necessary to analyze relevant practice in this area and opinio iuris sive necessitatis. After analyzing these two elements, we may conclude that the right to unilateral humanitarian intervention does not exist in the contemporary customary law. Even if such a right had existed before World War II, it was abolished by the UN Charter peremptory norm on the prohibition of the use of force. It is indisputable that, in the aftermath of World War II, the international community did not establish a new customary rule which would provide for undertaking unilateral humanitarian intervention by amending the pro¬visions of the UN Charter.

The aim of the paper is to highlight the current situation in the field of human rights in all regions of the world, especially by analyzing and com-paring the basic instruments adopted in each of them. The general conclusion is that the universality of human rights is not questioned by strengthening mechanisms for regional security. Quite the contrary, we believe that the current position of human rights in certain parts of the world, due to various political, economic or social factors demands commitment of universal, as well as regional and national mechanisms, which could lead to a favorable outcome only in coordination with each other.In the first part of the paper, author gave brief analysis of the mayor instruments in the field of human rights adopted in Europe, America and Africa. Likewise, the author devoted a considerable attention to the region of Asia, which lacks a developed system on the regional level, but shows significant steps towards the advancing of the sub-regional mechanisms. The central part of the paper is related to the comparison of the regional systems on the substantive and procedural level. In order to highlight one of the differences in the substantive aspect of the protection of human rights, the author analyzed the provisions on the right to life as a basic human right. On the other hand, the differences and similarities bet-ween the regional systems of human rights protection are especially visible in the procedural aspects of protection or in part concerning the jurisdiction and functioning of the mechanisms established by the above-mentioned instruments. Given the fact that we put the emphasis on the efficiency of the protection of individual rights, the author pointed out to the provisions on the right of individual access to regional institutions since the right of individual petition is "the cornerstone of the international protection of human rights".The general conclusion is that regional human rights protection systems do not operate in isolation, but in coordination with each other. However, the permeation of the provisions of regional and universal instruments should not be seen as a threat to any of the systems or as the reduction of the effectiveness of the various mechanisms, but only as a step toward complete protection of individual rights. In the near future we expect serious engagement of Asian countries to establish a sub-regional, if not regional, human rights protection system, modeled on existing European, American and African systems.

Existing theories about the concept of identity associate the redefinition of the identity of migrants with the awareness of the social status they possess in their new environment. The formation of social status contributes to anti-immigration feelings that widen the gap between locals and refugees. In light of these premises, this study aims to deepen the issue of identity development in the migratory field, focusing on the case of refugees. In order to do so, ethnographic work has been carried out in the Italian context, conducting twenty-eight interviews with adult refugees in the Salento area in southern Italy. The results of this research refer to the social status of refugees in Italy, as well as the provisional nature of their identities. The temporality of identities lies both in the condition of the refugee itself and in the effects of anti-immigration policies.

There is extensive scientific production in the field of Migration Studies within the Spanish context. Nevertheless, there are yet few review proposals of such production in the various disciplines. This work aims at contributing to fill this gap, by reviewing the PhD dissertations in Migration Studies in the area of Education Anthropology that have been discussed in Spanish Universities. To do so, we have used the material available in the repository of PhD dissertations in migrations housed at the Institute for Migration Research of the University of Granada (Spain). In our review, two types of data have been used as the object of analysis. The first type is more quantitative, referring to the number and evolution of the dissertations, as well as, the institutions to which they refer. The second type is more qualitative, referring to the contexts and subjects of study, and to the object of study or topic that they addressed.

The article discusses the meaning of the tomb effigy of Sigismund I the Old in his burial chapel at Cracow cathedral. It has been observed that distinctive way of posing the figure of the king in armour that represents the demi-gisant type could have been inspired by the ancient depictions of gods and heroes. Neoplatonic connotations of such an image were also underlined: a reclining monarch awakening from his sleep indicated the moment when the soul was leaving the body. According to the author appropriating the demi-gisant type for the Cracow tomb effigy was likely to demonstrate the analogy between Sigismund I and Hercules. It referred to the motive of Hercules at the crossroads (Hercules in bivio) based on the story in which the pagan hero, faced with a life choice, decided to follow path of virtue and earned himself eternal glory and salvation. Given the sepulcral context of the chapel, the formula of semi-recumbent effigy of the king must have evoked the association with Hercules as the only hero who was granted immortality. Thus, introducing the ancient pagan formula to the artistic setting of the king’s tomb did not undermine its Christian message – on the contrary, it corresponded perfectly with the eschatological views of Sigismund I, who repeatedly expressed his absolute conviction that kings were to be redeemed.

The article presents a practical-theoretical reflection on translating humorous poetry on the basis of the author’s experience as a translator of Wisława Szymborska’s "Rymowanki dla dużych dzieci" ("Rhymes for Big Kids"). Since humor is the dominant function of the text, and laugh is the expected reaction, functional equivalence – rather than the semantic one – is to be pursued here. The goal of any translator of humorous texts is to produce the equivalent effect on the reader. In the case of Szymborska’s "Rymowanki", the task is made more difficult by the poetic form, which plays a primary role in generating the comic effect. The author observes that the three categories of joke – universal, cultural and linguistic – proposed by Debra Raphaelson-West do not take into account such highly formalized utterings as humorous verses, in which the form is not a mere decoration aiming at potentiating the aesthetic effect, but definitely contributes to generating the humorous effect. The article shows how the mechanisms of laugh/smile proper of these poetic texts were reproduced in translation following some simple principles, and ends with the suggestion to add a fourth category to Raphaelson-West’s classification: a poetic joke.
