Summary/Abstract: The report prepared as part of the project "Monitoring the judicial system of Montenegro" contains observations on criminal cases, observed in the light of Article 6 of the European Convention on Human Rights, which is incorporated into domestic legislation and which in itself represents an accepted professional standard. However, this Report does not deal with all issues that are important for the functioning of the criminal justice system according to the standards of the European Convention (such as the execution of court decisions) nor does it pretend to provide an assessment of the independence, impartiality, efficiency and transparency of the entire judicial system. The purpose of the Report is to contribute to the establishment of such a system by identifying certain normative and factual obstacles that affect full respect for the right to a fair trial and defining recommendations for their removal. Taking into account the fact that the monitor's observations and evaluations can all the sooner become the subject of political and other evaluations, the implementation of monitoring was primarily focused on objective indicators and results, and not on the personality of judges and other actors in the process.
