Summary/Abstract: An enduring feature of EU competition law is the understanding of the competition as a process resulting from the exercise of freedom of choice by market actors. The present research examines what this freedom involves and establishes its role in creating the concept of abuse of a dominant position. It is concluded that this concept is based on ordoliberal thoughts of the Austrian School of Economics.
