Summary/Abstract: A health resort is a defined area within the administrative boundaries of municipalities, called spas, in which the natural healing properties of raw materials and climate are present. This results in spa treatment and rehabilitation being carried out in municipalities with this status. There are enumerated spa treatment facilities, which include hospitals, sanatoriums, clinics and natural healing facilities. Spa properties of municipalities are subject to certification in the form of a certificate, which is issued by authorized entities. They acquire such right in the form of an administrative decision issued by the minister in charge of health, provided that they meet the statutory conditions. Their lack or loss results in refusal or withdrawal of the right to certifica-tion. The decisions in these cases are subject to verification by way of a case reexamination or an administrative court complaint. In matters not regulated in the Health Resort Act, the provi-sions of the Code of Administrative Procedure apply. Hence, the verification of certification decisions takes place by means of a case review, to which the provisions on appeals apply ac-cordingly. This may result in: maintaining the decision in force, revoking it and ruling on the merits of the case, discontinuing the renovation procedure due to its lack of objectivity. The decisions made as a result of the review become final and are subject complaint to the adminis-trative court. Non-final decisions may also be subject to judicial review, therefore, without first exhausting the rehearing of the case. Rejection or rejection of both types of decisions makes them final.
