Summary/Abstract: The article addresses the issue of the participation of lay arbitrators in the labour justice system. According to the author, the specifics of employment legislation serve to legitimise the participation of lay persons, as evidenced by experience abroad. However, in order to increase the functionality and the necessary generational change of such arbitrators, it will be necessary to strengthen the independence of the process via the systemic adjustment of both the length of the arbitration mandate and the appointment mechanism. Such changes have the potential to enhance the quality and functionality of the participation of arbitrators in labour disputes, especially with respect to training and increases in remuneration.
