Current issues regarding the position of employees in individual labour legislation disputes

Summary/Abstract: The current form of employment legislation in the Czech Republic has, for many years, remained resistant to a range of proposals aimed at strengthening the procedural position of employees. The author of the article, therefore, draws attention to the potentially beneficial attrition of this age-old model from the outside, i.e. in the form of the mandatory implementation of European legislation. In this respect, 2023 witnessed a number of significant impulses, especially concerning legislation in the area of retaliatory measures imposed by the employer and the protective principles applied in legal proceedings that reflect the presence of labour relations inequality. The author opines that these developments represent a fundamental value shift that suggests the potential for the introduction of further legislative changes in this area.
