Summary/Abstract: The legislator guaranteed the right to rest for every employee defining it as one of the basic principles of labour law. The article mainly presents issues related to daily and weekly rest and vacation. The rest is necessary for physical and mental regeneration. The right to rest is an entitlement but also an obligation for an employee. A rested employee performs given tasks more carefully and effectively. The increase in symptoms of tiredness, i.e. a decrease in a work capacity is largely due to insufficient rest. Therefore the employer should also care for the employee to use the right to rest.
