The Protection of the Employer against Attempts for Misuse of Labour Rights by Workers and Employees

Summary/Abstract: The study aims to reveal the reasons that may trigger the adjustments of some employees for misuse of their labour rights. The issue has rarely been subject of research in the legal theory. The article, therefore, makes an attempt to definr the concept of „misuse of rights“ as a violation of the principle of bona fides in the exercising of labour rights and obligations. The analysis focuses also on some practical examples of unfair actions. The difference between the culpable non-performance of labour obligations and the misuse of labour rights is examined. In conclusion, some possible measures for counteraction against such type of behavior are proposed.
