Mortgage charges consideration in determining the value of joint matrimonial property in case division of marital assets

Resolution of Seven Judges of Supreme Court of 27 February 2019 in Case III CZP 30/18

Summary/Abstract: Supreme Court assumed that in determining the value of the subject property the division after the termination of marital joint property should be taken into account its market value without consideration mortgage charges. A compromise was allowed to reduce the value of such property in situations where specific circumstances of the case indicate such need. A better solution would be to reverse the rule and take a stand for the previous practice in taking into account the mortgage burden when determining the value of real estate.
