Summary/Abstract: In the period from 1956 to 1989, several hundred thousand persons emigrated from Poland to the Federal Republic of Germany. Many of them left real estate property in Poland. The fate of this real estate property was legally regulated only to a limited degree. Particular attention should be paid to article 38 of the Act on land management in towns and settlements. This regulation deprived persons emigrating from Poland of ownership rights and of the right to dispose of their property before emigrating. The comments below pertain, above all, to the extent to which this regulation was applied and to the legal effects that may presently ensue from its having been operative during a period when many real estate property owners emigrated to the FRG.
