Summary/Abstract: The commentary to the judgement of the Supreme Court – Criminal Chamber of 4 July 2018, case reference number III KK 430/17, is devoted to the thesis of the Court regarding the condi- tion of acting in the framework of the necessary self-defense under art. 25 § 1 of the Criminal Code of 1997. The position of the Supreme Court has been approved by the author.
