Summary/Abstract: The present research aims to analyse, on the one hand, the Romanian legislation applicable in the area of diaspora, regarding the rights and obligations of migrants, and on the other hand, the public policies implemented by the state in support of the diaspora, in particular, in supporting those who wish to return to their country of origin.Regarding the first aspect mentioned, this work will consist of an analysis of the rules applicable in the matter, starting from the European requirements, and continuing with those at national level, to observe, in particular, whether the right applicable to the diaspora, at national level, is directly aligned with the requirements of the European Union, in the sectors in which the Union legislation establishes common principles, rules or procedures.Since its emigrants and descendants, continue to be relevant political and economic actors in the countries of origin , despite the fact that they no longer live in their territory (they have the right to vote, pay/should pay contributions) we consider relevant not only the knowledge of the national regulations applicable to the diaspora, but also the knowledge of the public policies, considered by the state, regarding the diaspora, a brief analysis of them will be presented in the research paper.
