Summary/Abstract: Given the ever-growing number of personal relations between persons from different states and as a reply to the globalization tendency that no state can ignore, the European Union institutions have passed Regulation (EC) no. 2201/2003, which has the purpose of putting into place a system of uniform rules applicable to the member states, in matrimonial matters and matters of parental responsibility. The first question that arises in a litigation regarding divorce, legal separation or marriage annulment with a foreign element, regards the identification of the national courts with jurisdiction to hear the case. Therefore, this article analyzes the provisions on jurisdiction in the aforementioned cases, rules which are essential for the validity of the award and especially for its subsequent recognition and enforcement.
