RECOGNITION AND ENFORCEMENT IN ROMANIA OF FOREIGN JUDGMENTS PASSED IN CIVIL AND COMMERCIAL MATTERS

Summary/Abstract: Regulation (EC) No. 44/2001 (Brussels I Regulation) on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, attempts to facilitate the legal treatment applicable to judgments given in European Union member states, thus promoting the strict observance and accepting of effects and execution of said judgments, in any solicited member state, other than the state of origin of the judgment. The conditions and procedures which have to be observed for the recognition and enforcement of foreign judgments in Romania, as well as the cases which entail the refusal of recognition, form the object of the present study. The proposed research emphasizes the manner in which judicial cooperation in civil and commercial matters is being instituted and accomplished in Europe, by member states authorities, with the scope of overcoming any obstacles deriving from the incompatibilities of different legal systems.
