Transfer of rights in the Civil Code Slovak republic in the new legal regulation

Summary/Abstract: This article is a topical response to the amendment of the institute of securing transfer of rights in the Civil Code. It confronts the new legal regulation with the practice as it has been until now and points out some of its provisions. The new conception of the securing transfer of right represents a transfer with a resolute condition where after the debt has been paid off, the right is transferred back to the debtor. However, the issue of certain tax connections as well as some inaccurate formulations by the legislators have been left open; and the article deals with these issues critically.
