Summary/Abstract: In this article, the authors try to answer the question whether the public sector should cooperate with the private sector in the implementation of public tasks. They point to specific features characterizing individual sectors. At the same time, they show that public procurement is the main level of mutual relations between the two sectors. In this area, the activities of both sectors try to determine interactions that occur inter alia, which will indicate the need for mutual cooperation. The conducted analysis leads the authors to conclude thatinter-sectoral cooperation within the framework of public-private partnership is nowadays a specific form of reconciliation between the interests of the state and the private sector, sinceits establishment enables the implementation of basic tasks of the public sector on the one hand and satisfying the profit of private entities on the other.
