A Few Notes on the Health Care Act's Inter Temporary Rules

Summary/Abstract: The Article deals with a weird legal situation in the Czech Republic. Although the Specific Health CareServices Act comes into force on 1 April 2012, the Ministryof Health and the Ministry of Labour and SocialAffairs officially represented on 29 March 2012 a differentopinion. According to the ministries´ statement,almost the whole act is inapplicable and employersshall obey the old regulations. Authors of this articleargue for obedience of the new law. The irrationality or inefficiency of a law approved by the Parliament is nota sufficient reason to disobey the law. In addition, thereare other pressing arguments, such as serious sanctionsin the case of violation of the new law and the existenceof other agencies legally not bound by the statementissued by these two ministries. These agencies maycome to a different conclusion in their practice.
