Summary/Abstract: Through this article we intend to make an analysis of the judgment which substitutes the act of sale through the conditions for transfer of ownership. Besides expressed valid consent, the court will consider the legal nature of the contract between the parties, exceptions relating to territorial jurisdiction, material competence, prescription and some formalities related to real estate advertising.
