Summary/Abstract: Through this paper we propose to do an analysis of the laws regarding the right of first refusal as they were established by the Civil Code of 2011, with reference to the rules of other laws that contain provisions relating to the right of preemption as well as references to legal doctrine and other European legal systems also aiming to identify the main benefits of the new regulations and the possible drawbacks.
