Summary/Abstract: The new Code of Civil Procedure has brought a number of important changes in the acknowledgement institution, in both of its forms(the acknowledgement of the defendant toplaintiff's claims and the acknowledgement of the party who lost the case to the court’s decision).The new regulation is superior, so the express distinction of the different forms of acknowledgement, as well as through the establishment of a new institution, theone of the conditioned acknowledgemen, intended to clarify the jurisprudențial and doctrinalpoints of view that are controversial, being necessary to delimit this institution from the institution of the legal transaction. Article aims both in theoretical treatment and interpretation of new rules relating to certain practical hypotheses that could be problematic.
