Summary/Abstract: With novelty character, the art. 22 para. (3) C.proc.civ. - regarding the active role of the judge in finding the truth - establishes the possibility of the judge to decide the introduction of other persons in the cause, under the law, a change that is apparentely of substance, before this regulation, talking , at most, about questioning the parties in what concerns the introduction of a third party in the cause. This institution is closely related to the forced introduction provided by art. 78 and seq. C.proc.civ, in cases expressly stipulated by the law and in non-contentious procedures(where, not aiming at establishing an adverse situation, giving the fact that there is no defendant, the intervention is even justified).
