The Crime of Obstruction of Justice

Summary/Abstract: The aim of this article deals with the new crime of obstruction of justice, which was adopted by the last amendment to the Criminal Code (amendment no. 287/2018). The proposal caused a great deal of discussion among the legal professionals. In the Government's view, the crime of obstructing justice responds to the requirements of EU or international organisations. In fact, accepting and practical application of this new crime, is likely to cause significant practical problems. Its use in practice may not lead to the intended effect,but may represent another instrument of criminal repression against accused persons and intervene in the independence of advocacy.
