Selected problems of the polish public contract markets from contractors’ perspectives

Summary/Abstract: The purpose of the article was to identify the most important barriers to the functioning of the Polish public procurement market for contractors. The main research method used in the work was a diagnostic survey, in which an in-depth, categorized, open-ended interview was used. The survey was conducted in the first quarter of 2017 among 34 entities from the Opolskie Voivodeship. The analysis of the results of the conducted research has shown that the main barriers to the public procurement market are: a complex procedure for submitting offers, procedure for selecting contractors, primacy of the price, as the main criterion for selection of bidders, too wide range of contractual penalties and a complicated and costly appeal procedure. In order to improve the competitiveness of the Polish public procurement market, it was recommended, among others, to undertake educational activities, facilitate access to information, extend the obligation to publish orders, extend the time of submitting the offer and counteract bid rigging.
