Application of Necessary Defense in Connection with Realization of Immediate Friendships

Summary/Abstract: The factual acts are a legal theoretical notion that includes various specific forms of public administration that are used in extraordinary situations, as a rule instead of individual administrative acts. One of the forms of deeds is represented by so-called immediate interventions. Due to the immediate nature of this legal form of activity, the possibility of reviewing the lawfulness by means of ordinary remedies, as is the case with individual administrative acts, is precluded in the period before the legal consequences for the addressees of its action. However, from the set of legality safeguards commonly used in the area of public administration, citizenship control can be exercised in this case in the form of necessary defense. Similarly, however, officials authorized to carry out immediate interventions are entitled under certain circumstances to use the necessary defense institute.
