Summary/Abstract: The right to liberty belongs to the most fundamental human rights. In the light of the Convention for the Protection of Human Rights and Fundamental Freedoms, suspects and accused persons, which do not have sufficient means to pay for legal assistance, should have the right to free legal aid, if it is required by the interests of justice. The adoption of the Directive on legal aid has completed the implementation of the roadmap for strengthening procedural rights of suspected or accused persons in criminal proceedings. The aspects of the legal aid in criminal proceedings, dealt with in the Directive on legal aid, have been identified as very important to complement the effective implementation of the directive and to ensure the rights of access to a lawyer and to improve mutual trust between the systems of criminal justice.
