Summary/Abstract: The General Data Protection Regulation (GDPR) provides the possibility of processing personal data where it is necessary for the legitimate interests of the controller or a third party without the consent of the data subject. In order for this legal ground provided for in Article 6 (1) (b) of Regulation (EC) 2016/679 to apply, it is necessary that the legitimate interests or fundamental rights and freedoms of the data subject that require protection of personal data do not take precedence over the legitimate interests of the controller or a third party. The following publication analyzes the application of the balance of interests test in the light of the requirements laid down in the GDPR.
