Summary/Abstract: In Polish legislation, the concept of a family farm operates on the basis of constitutional regulations, however, this provision does not define nor, however, indicate any criteria allowing to distinguish family farms from all agricultural holdings. Doubts that arise in this context have often been the subject of decisions made by the Constitutional Tribunal or the Supreme Court. The recognition of family farms as a constitutional basis for the functioning of the agricultural system in Poland is connected with the historical development of agriculture. The social aspect of the solution adopted also plays an important role. Undoubtedly, the legal standard set by the legislator determined the directions of development and influenced the specificity of agricultural holdings in Poland.
