Summary/Abstract: Pardon study, from the historically-legal aspect, points to the fact that this is a criminal law institute of a long-standing tradition, since his regulation dates back to the Hamuraby`s Code. The line of its development can be clearly tracked through ancient Greece and Rome, mid-century to modern legal systems, with brief episode of suspension in post-revolutionary French law, which represents the only known case of discontinuity in its long and rich history. General overview of the historical development introduces the consideration of the central question that authoress engaged in this paper, and that is the history of pardon in Serbian legislation. It begins with the interpretation of the most significant criminal law sources in the Middle Ages, where special attention is devoted to Tzar Dushan`s Code, continues with the analysis of codes passed after liberation from the Turkish government as well as a number of other insufficiently known laws regulating pardon in some aspects, and ends considering solutions given in the Criminal code of Yugoslavia from 1929 and its amendments.
