The property benefits of the divorce due to the exclusive fault of one of the spouses

Summary/Abstract: Although in the latest decades, the dissolution of marriage has had a spectacular evolution, its contractualisation becoming much more important, the legislator maintained and even provided certain important effects of the exclusive fault in the dissolution of marriage for the first time in the Romanian legislation. These material benefits, which the innocent spouse may benefit from in the event of divorce shall refer to the grant of use of common residence or of the benefit of the lease agreement in the case of a rented dwelling, the right to indemnifications, the compensatory allowance and, within certain limits, the obligation of support between the ex-spouses. We will further examine all these advantages, focusing on certain special situations that may appear in the practice (awarding the lease agreement in the case of social housing, official lodging, necessity, intervention, support and protocol lodgings), but also on the differences among them, by marking the conditions under which each of them is granted.
