Summary/Abstract: The court's solution is at least strange and the questions that arise are: Why have the appellant's claims been upheld and not the allegations made by the appellant? Why does the recruiter benefit from greater probity, morality, creditworthiness or honesty than the intimate? What was, in fact, the reason for pronouncing such a solution that defies all civilian procedural rules? The court wrongly based its judgment on admitting the appeal and altered the decision of the substantive court solely on the submissions of one of the parties without any other admissible evidence capable of provoking such a change.
